By accessing https://openrp.ai (“the Site”), you agree to be bound by these Terms of Service and all applicable laws and regulations. OpenRP, Inc. provides an AI-powered interactive storytelling platform.

Your use of the Service is also governed by our Privacy Policy, available at https://openrp.ai/privacy, which details how we collect, use, and protect your personal information.

1. Eligibility & Age Requirement

You must be at least 18 years of age to use this Service. The Service is intended for adults only. By creating an account, you represent and warrant that you are at least 18 years old. We reserve the right to terminate accounts and/or request age verification at any time.

2. User Conduct & Prohibited Content

OpenRP, Inc. maintains a zero-tolerance policy for certain content. You agree not to use the Service to generate, host, or share:

Illegal Content: Including Child Sexual Abuse Material or any content depicting minors in a sexual or suggestive context.
Non-Consensual Imagery: Non-consensual sexual content or deepfakes of real people.
Harmful Content: Content that promotes real-world violence, self-harm, or illegal acts.
Fraudulent Activity: Using the service to deceive, or using stolen payment methods.
IP Infringement: Content that infringes on third-party intellectual property.

3. Subscriptions, Payments, and Billing

Payment Processor: Payments are securely processed via Stripe. By subscribing, you authorize OpenRP, Inc. (via Stripe) to charge your provided payment method for the recurring fee associated with your selected plan.
Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled.
Cancellation Policy: Users may cancel their subscription at any time by navigating to Account Settings > Account > Manage Subscription. Upon cancellation, you will retain access to the Service until the end of your current paid billing period. No further charges will be made after cancellation.

4. Refunds and Disputes

Refund Policy: All sales are generally final. However, if you have not used any credits or benefits from your current billing cycle, you may request a refund within 14 days of the transaction by contacting support@openrp.ai.
Technical Issues: If a technical error on our part prevents access to the service, we will issue a pro-rated refund or credit.
Chargebacks/Disputes: We encourage users to contact our support team at support@openrp.ai to resolve any billing discrepancies. Fraudulent chargebacks may result in the permanent termination of your account.

5. Ownership & Intellectual Property

User Ownership: You own the rights to the text inputs you provide and the text outputs generated by the AI through your account, subject to these Terms.
Indemnity: You agree to indemnify and hold OpenRP, Inc. and its officers harmless from any claims, losses, or legal fees resulting from your use of the Service or your violation of these Terms.

6. AI Training & Data Privacy

We value your privacy and the creative integrity of your roleplays. OpenRP, Inc. does not use your private roleplay data, inputs, or generated outputs to train our AI models, nor do we sell your personal data to third parties. 7. Account Security & Termination

Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and are fully liable for all activities that occur under your account.
Right of Termination: We reserve the right to suspend or terminate your account, at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms.

8. DMCA & Copyright Takedown Notice

OpenRP, Inc. respects the intellectual property rights of others. If you believe that your copyrighted work has been infringed upon by content hosted on our Site, please send a written notice to our designated legal team at legal@openrp.ai. Your notice must include proof of ownership, a description of the copyrighted work, and the exact location (URL) of the alleged infringing material on our Site.

9. Disclaimers & Limitation of Liability

AI Hallucinations & Fictional Content: The Service generates fictional content for entertainment purposes only. AI can occasionally "hallucinate" or produce inaccurate, biased, or nonsensical information. OpenRP, Inc. makes no warranties regarding the accuracy or appropriateness of AI-generated content. The AI should not be relied upon for medical, legal, financial, or professional advice. Any resemblance to real persons, living or dead, or actual events is purely coincidental.
Limitation of Liability: The Service is provided on an “AS IS” and “AS AVAILABLE” basis. In no event shall OpenRP, Inc. be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service.

10. Governing Law & Dispute Resolution

Governing Law: These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Arbitration & Class Action Waiver: Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration, rather than in court. You agree to waive any right to participate in a class-action lawsuit or class-wide arbitration.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify users via email or by placing a prominent notice on the Site. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

12. Export Control

By using the Site, you represent and warrant that you are not located in a country subject to U.S. Government embargo (e.g., Iran, North Korea) and are not on any U.S. Government list of prohibited or restricted parties.
